These terms and conditions of use, together with the policies, notices and disclaimers referred to below (Terms & Conditions), govern your use of the website at collagenstickz.com and pages that belong to that URL collectively referred to as "the Site".

The Site is operated by the Jackson & Rose Partnership ABN 88 180 306 495. The Site is designed to provide information about Collagen Stickz products and their use. The Site does not provide general health, dietary or fitness information or advice. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions. You acknowledge that nothing on the Site or in its Content constitutes medical advice specific to any individual.

SITE USE

Your access to and use of the Site, including materials provided within the Site, and information accessed on or via the Site and the ordering of products from the Site, is governed by these Terms & Conditions. Your use of the Site is conditional upon your acceptance and compliance with these Terms & Conditions. You should read the Terms & Conditions carefully. By using the Site, you agree to be bound by, and comply with, these Terms & Conditions. You must not access, browse or otherwise use the Site unless you agree to be bound by the Terms & Conditions. Collagen Stickz reserves the right to amend the Site and the Terms & Conditions at our discretion. Your continued use of the Site after any amendment to the Terms & Conditions constitutes an agreement by you to abide by our Terms & Conditions as amended. If you breach these Terms & Conditions, your right to use the Site may be terminated. By agreeing to these Terms & Conditions, you also agree to the terms of the Collagen Stickz Privacy Policy. Access to the Site is not provided on a continuous, uninterrupted or permanent basis. Products and services offered on the Site may vary from time to time. Collagen Stickz reserves the right to withdraw or amend the Site and products offered at our discretion. The products and services offered through the Site may be altered or removed without notice. Collagen Stickz is not liable if, for any reason, the Site is unavailable for any period of time.

TRANSACTIONS

Collagen Stickz reserves the right to refuse to process orders for any reason or refuse services to persons at any time at its sole discretion. If your financial institution (PayPal or as applicable) declines to process your payment request, Collagen Stickz will not be liable to you or any third party by reason of unwinding or suspending any transaction after order processing has begun.

REFUNDS/EXCHANGES

In the event that you have received a refund, an exchange and/or a temporary replacement Product for Product purchased through the Site or via customer service and you have not returned that Product and/or the temporary replacement Product to us within ten (10) business days after you have received a refund, or you received a refund that was greater than the amount you paid, then you agree that we can hold and not process any pending and/or any future orders from you until we have received the Product or full payment from you. You also agree that if a Product for which you received a refund or exchange, or a temporary replacement Product is not returned to us within ten (10) business days after you are issued a refund, then we may utilise your current or future Payment Information to re-charge you for that Product at any time.

REGISTRATION / USER NAMES / PASSWORDS

You may need to register to use all or part of the Site. We may reject, or require that you change, any username, password or other information that you provide to us in registering. Your user name and password are for your personal use only and should be kept confidential. You are responsible for any use or misuse of your user name or password, and you must promptly notify us of any confidentiality breach or unauthorised use of your user name, password or account.

Certain content, products and services available via our Service may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.

YOUR USE OF THIRD PARTY MATERIALS IS AT YOUR OWN RISK AND IS SUBJECT TO ANY ADDITIONAL TERMS, CONDITIONS AND POLICIES APPLICABLE TO SUCH THIRD PARTY MATERIALS (SUCH AS TERMS OF SERVICE OR PRIVACY POLICIES OF THE PROVIDERS OF SUCH THIRD PARTY MATERIALS.

TAXES & BORDER FEES

Prices displayed on the Site are inclusive of GST on the sale unless otherwise stated. You are responsible for the payment of any and all taxes, duties, charges, imposts or other liabilities imposed by any government agency, government taxation agency or other government body, including without limitation, any customs duty, any additional GST payable or any value added tax imposed on any products or services acquired or ordered by you via the Site. The Site is operated in NSW, Australia. If you are not an Australian resident you must make enquiries with the relevant border authority with regard to any additional charges related to your region and whether those charges will be imposed on your orders, where and how those fees must be paid and be solely responsible for payment of those fees. Collagen Stickz is not responsible and assume no liability for any comments posted by users on our Site or on any third-party website.

COMMENTARY

User comments on or via the Site must not violate any right of any third-party, or individual (including copyright, trademark & privacy). User commentary must not contain libellous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Site or any related website. You may not use a false e‑mail address or pretend to be someone other than yourself with the intention of misleading Collagen Stickz or any third-party associated with the Site as to the origin of any commentary. Collagen Stickz is not responsible and assumes no liability for any comments posted by users on or via our Site or any third-party website.

INDEMNITY

To the fullest extent permitted under applicable law, you agree to defend, indemnify and hold harmless Collagen Stickz (Jackson & Rose Partnership) and the Affiliated Entities from and against all claims, losses, costs and expenses (including attorneys' fees) arising out of your use of, or activities in connection with, any or all of the Site and related products and including any violation or alleged violation of this Agreement by you.

LIMITATION OF LIABILITY.

To the fullest extent permitted under applicable law, Collagen Stickz (Jackson & Rose Partnership) will not be liable for any indirect, incidental, consequential, special, exemplary or punitive damages of any kind, under any contract, tort, strict liability or other theory, including damages for loss of profits, use of data, loss of other intangibles, loss of security or information transmitted via the Site (including unauthorised interception by third parties of such information), even if advised in advance of the possibility of such damages or losses. Without limiting the foregoing, to the fullest extent permitted under applicable law:

a) Collagen Stickz (Jackson & Rose Partnership) will not be liable for damages of any kind resulting from your use of or inability to use the Site or product or services or third party materials
b) your sole and exclusive remedy for dissatisfaction with the Site, our products or services or third party materials is to stop using the Site and related products and services,
c) the maximum aggregate liability of Collagen Stickz (Jackson & Rose Partnership) for all damages, losses and causes of action, whether in contract, tort (including negligence) or otherwise shall be limited to the total amount, if any, paid by you to Collagen Stickz to use the Site and/or products and services. The terms of this Agreement are governed by the laws of the NSW, Australia.

RULES OF CONDUCT

In connection with the Site, you must not:

Post, transmit or otherwise make available through or in connection with the Site any materials that are or may be:
threatening, harassing, degrading, hateful or intimidating, or otherwise fail to respect the rights and dignity of others;
defamatory, libellous, fraudulent or otherwise tortious;
obscene, indecent, pornographic or otherwise objectionable; or
protected by copyright, trademark, trade secret, right of publicity or privacy or any other proprietary right, without the express prior written consent of the applicable owner.
Post, transmit or otherwise make available through or in connection with the Site any virus, worm, Trojan horse, Easter egg, time bomb, spyware or other computer code, file or program that is potentially harmful or invasive or intended to damage or hijack the operation of, or to monitor the use of, any hardware, software or equipment.
Use the Site for any purpose that is fraudulent or otherwise tortious or unlawful.
Harvest or collect information about users of the Site.
Interfere with or disrupt the operation of the Site or the servers or networks used to make the Site available, including by hacking or defacing any portion of the Site or violate any requirement, procedure or policy of such servers or networks.
Restrict or inhibit any other person from using the Site.
Reproduce, modify, adapt, translate, create derivative works of, sell, rent, lease, loan, timeshare, distribute or otherwise exploit any portion of (or any use of) the Site except as expressly authorised herein, without Collagen Stickz express prior written consent.
Reverse engineer, decompile or disassemble any portion of the Site except where such restriction is expressly prohibited by applicable law.
Remove any copyright, trademark or other proprietary rights notice from the Site.
Frame or mirror any portion of the Site or otherwise incorporate any portion of the Site into any product or service, without express prior written consent from Collagen Stickz.
Systematically download and store content of the Site.
Use any robot, spider, site search/retrieval application or other manual or automatic device to retrieve, index, "scrape", "data mine" or otherwise gather content from the Site or reproduce or circumvent the navigational structure or presentation of the Site without express prior written consent from Collagen Stickz.

PROPRIETARY RIGHTS

Collagen Stickz and our suppliers own the websites and Apps which are protected by proprietary rights and laws. If you fail to comply with any of the terms or conditions of this Agreement, you must immediately cease using the Apps by removing and uninstalling (deleting) the Apps from your devices. All trade names, trademarks, service marks and logos on the Site not owned by us are the property of their respective owners. You may not use our trade names, trademarks, service marks or logos in connection with any product or service that is not ours, or in any manner that is likely to cause confusion. Nothing contained on the Site should be construed as granting any right to use any trade names, trademarks, service marks or logos without the express prior written consent from the owner.
